Legal terms & conditions

  1. Acceptance of Terms Participation in the Contest constitutes the entrant’s full and unconditional acceptance of, and agreement to be bound by, these Terms & Conditions (the “T&Cs”) and Elementor’s Terms of Service.
  1. Definitions
  • Contest” – The promotional competition identified in the Contest Summary Sheet.
  • Participant” – A natural person who submits an eligible entry in accordance with Section 4.
  • Organizer” – Elementor Ltd., 40 Toval St., Ramat Gan, Israel (“Elementor”).
  • Platform” – Any social-media service listed in the Contest Summary Sheet.
  • “Contest Summary Sheet” – The campaign information table at the top of this page.
  1. Eligibility

The Contest is open to individuals who (i) are at least 18 years of age (or the age of majority in their jurisdiction, if higher) at the time of entry, and (ii) have legal capacity to participate.

You are not located in, or a national or resident of, any of the following: Cuba, Iran, North Korea, Syria, Yemen, Russia, Belarus, Lebanon, Gaza, the Crimea region of Ukraine, the Donetsk People’s Republic (DNR), or the Luhansk People’s Republic (LNR). You are also not listed on any U.S. government list of prohibited or restricted parties, including but not limited to the OFAC SDN List, BIS Entity List, or State Department Debarred List.

Employees, officers, directors, representatives and agents of Organizer and each of their respective affiliates, and members of their immediate families or households, are not eligible.

The Contest is void where prohibited by law. Participants are solely responsible for ensuring their participation is lawful in their jurisdiction.

  1. How to Enter

Entry Requirements. Participants must complete all Entry Requirement steps stated in the Contest Summary Sheet on the top of this page during the Contest Term.

Single Entry Limit. Participants can post once on each of the 7 platforms. Multiple entries by the same individual in the same platform (as determined by Organizer) will be discarded.

Organizer reserves the right to disregard, disqualify or delete any entry it believes to be fraudulent, abusive, or non-compliant with these T&Cs.

  1. Judging & Winner Selection

Eligible entries will be evaluated by a panel appointed by Organizer in accordance with the Judging Method & Criteria specified in the Contest Summary Sheet.

Contacting finalists. Organizer will attempt to contact potential finalists via direct message on social media and ask for a live link to their site as well as their shipping details. If (a) the account is private, (b) messaging is disabled, (c) the notification bounces, or (d) the finalist does not respond within 48 hours from the first contact, the entry will be forfeited.

The panel’s decision is final and binding; no correspondence will be entered into.

  1. Prize

The prize(s) described in the Contest Summary Sheet are personal, non-transferable, non-assignable and not redeemable for cash or credit.

Organizer may substitute a prize with one of equal or greater value if the original becomes unavailable.

All taxes, duties, customs, transfer fees and ongoing service fees related to accepting or using a prize are the sole responsibility of the winner.

Organizer reserves the right to refuse or withdraw a prize from any winner who is believed to be in breach of these T&Cs.

  1. Intellectual Property & Publicity Licence

Licence Grant. By submitting any text, image, video, code or other material (“Submission”), Participant grants Organizer a worldwide, perpetual, irrevocable, royalty-free, transferable and sublicensable licence to use, reproduce, publish, display, distribute, adapt, modify and create derivative works from the Submission for (i) administering the Contest and (ii) marketing, promotional and commercial purposes connected with Organizer’s business.

Warranties. Participant warrants that (i) the Submission is original and does not infringe any third-party right; (ii) Participant has all rights necessary to grant the licence above; and (iii) the Submission complies with all applicable laws, regulations and platform policies, including required advertising disclosures.

Moral Rights. To the extent permitted by law, Participant irrevocably waives (and agrees not to assert) any moral rights or similar rights in the Submission.

Publicity. By entering, Participants consent to Organizer’s use of their name, username, likeness, city and country for winner announcements and transparency purposes across Organizer’s channels, without additional compensation. Participants further acknowledge that if they refuse or later withdraw this publicity consent, Organizer may, at its sole discretion, declare the prize forfeited and select an alternate winner.

  1. Disclaimer Relating to Participant Advertising 

Organizer is not responsible for, and expressly disclaims all liability arising from, any advertisement, endorsement or representation made by Participants in connection with the Contest. 

Participants are solely responsible for ensuring such communications comply with applicable laws, regulations and advertising standards, including clear disclosure of any material connection to Organizer.

  1. Privacy & Marketing Consent

Personal data collected from Participants will be processed in accordance with Organizer’s Privacy Policy and solely for the purposes described in these T&Cs.

Where indicated in the Contest Summary Sheet or campaign assets, by entering the Contest Participants agree to receive marketing communications from Organizer. Participants may withdraw consent at any time via the unsubscribe link included in every e-mail.

  1. Limitation of Liability & Release & No-Tampering

To the maximum extent permitted by law, Organizer and its affiliates, officers, employees and agents shall not be liable for any indirect, incidental, consequential, special or punitive damages arising out of or in connection with the Contest or these T&Cs.

Organizer’s aggregate liability shall not exceed supplying the stated prize(s) once.

By participating, Participants release and hold Organizer harmless from any and all liability, loss or damage arising from or in connection with their participation in the Contest or the acceptance, receipt or use of any prize.

No Fault / No Obligation. Organizer assumes no responsibility and will not be liable for: (a) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, corrupted or otherwise not received for any reason; (b) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties of any kind; (c) errors (human, technical or otherwise) that may occur in the entry process, administration of the Contest or the announcement of winners; (d) any inability of a potential winner to accept a prize for any reason; (e) failure to award a prize due to force-majeure events including, without limitation, natural disasters, terrorism, weather, governmental restrictions or any other event beyond Organizer’s reasonable control; or (f) any damages, injuries or losses of any kind caused by a prize or its use.

Tampering. Any attempt by a Participant or any other person to deliberately damage or undermine the legitimate operation of the Contest may constitute a violation of criminal and civil laws. Organizer reserves the right to disqualify any person it believes to be tampering, to seek damages and other remedies to the fullest extent permitted by law, and to cancel, terminate, modify or suspend the Contest as set out in Section 12.

  1. Indemnity Participant shall defend, indemnify and hold Organizer harmless from and against any claims, damages, liabilities, losses, costs or expenses (including reasonable attorneys’ fees) arising out of or related to (i) Participant’s breach of these T&Cs, (ii) infringement of any third-party rights by a Submission, (iii) Participant’s unlawful conduct, or (iv) Participant’s violation of any applicable law.
  1. Modification, Suspension or Termination Organizer reserves the right to modify, suspend or terminate the Contest (or any part of it) and/or these T&Cs at any time if it determines, in its sole discretion, that the Contest cannot be conducted fairly or properly for reasons including but not limited to force majeure, technical failure, fraud, or any other factor beyond its reasonable control.
  1. Platform Disclaimer

This promotion is in no way sponsored, endorsed or administered by, or associated with, any Platform. Participants release each Platform from any liability arising out of or relating to the Contest.

  1. Governing Law & Jurisdiction 

Except where prohibited by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these T&Cs, or the rights and obligations of Participants and Organizer in connection with the Contest, shall be governed by and construed in accordance with the laws of the State of Israel, without giving effect to any choice-of-law or conflict-of-law provisions.

Each Participant irrevocably (i) submits to the exclusive jurisdiction of the competent courts located in the Tel-Aviv–Yafo District, Israel, for any dispute or claim arising out of or relating to the Contest or these T&Cs; and (ii) waives any objection to venue or to the jurisdiction of such courts, including any claim of inconvenient forum or lack of personal jurisdiction.

  1. Miscellaneous

Severability. If any provision of these T&Cs is held unenforceable, the remaining provisions shall remain in full force and effect.

No Waiver. Failure by Organizer to enforce any provision shall not constitute a waiver of that provision or any other provision.

Entire Agreement. These T&Cs (together with Elementor’s Terms of Service and the Contest Summary Sheet) constitute the entire agreement between Organizer and Participant relating to the Contest and supersede all prior communications.
