Affiliate Program Terms and Conditions

*The English version of this Agreement and all related policies is the official and legally binding version. Translations, if provided, are for convenience only and shall not be considered as official documentation.

Thank you for your interest in Elementor’s Affiliate Program (the “Program”). By participating, you agree to be bound by the terms and conditions outlined in this Agreement, which governs your relationship with Elementor Ltd (“Elementor”).

This Affiliate Program Agreement (also referred to as the “Agreement,” “Affiliate Agreement,” “Terms and Conditions,” or “Affiliate Program Terms and Conditions”) is a legally binding contract between Elementor Ltd and the Partner (also referred to as “You,” “Affiliate Partner,” or “Affiliate”). This Agreement is effective upon your electronic acceptance.

By electronically accepting this Agreement, you confirm that you have read, understood, and agreed to:

  1. Be bound by the terms outlined herein.
  2. Abide by Elementor’s Terms of Service Agreement, which is incorporated by reference into this Agreement.
 

The terms “we,” “us,” or “our” refer to Elementor. The terms “you,” “your,” “User,” or “Affiliate” refer to the individual or entity accepting this Agreement. No provision in this Agreement confers any third-party rights or benefits.

1. NOTIFICATIONS AND COMMUNICATION

Elementor may occasionally notify you of changes to this Agreement via email. By participating in the Affiliate Program, you agree to receive such communications. If you choose to opt out of email notifications, you acknowledge that you may not receive important updates related to the Program.,  It is your responsibility to keep your account information including your email address, accurate and up-to-date. . Elementor assumes no liability if you fail to receive notifications due to outdated or inaccurate account details.

2. PARTICIPATION IN THE AFFILIATE PROGRAM

To enroll in the Affiliate Program, you must submit your application through the affiliate signup form available on the Elementor website (the “Site”). All applications will be reviewed by Elementor. Upon review, Elementor will determine whether to accept or reject the application at its sole discretion. If your application is deemed unsuitable for the Affiliate Program, it may be rejected for any reason, without the obligation to provide an explanation.

Nature of the Relationship

When joining the program, and upon our approval, you will be appointed as a non-exclusive affiliate, and you shall act to refer new potential customers to purchase our products and services. As our affiliate, you may not present yourself as a part of Elementor, and may not create any obligation on behalf of Elementor

Your participation is personal, meaning that you cannot have sub-affiliates or share your affiliate fees with anyone else.

You shall invest reasonable time in promoting our products and services, and do it with good quality; if we find that your promotional material is problematic, offensive, illegal or otherwise objectionable, we may terminate your participation in the program.

You represent and warrant that you are able to participate in the program, that you will only act in a legal, bona fide manner and that you will not infringe on any intellectual property right or act in any deceptive practice when participating in it.



As an independent contractor, You are responsible for handling your own taxes and securing any necessary insurance. In addition, your earnings will only include the commissions specified in the Affiliate Program, paid according to the designated schedule.You are solely responsible for complying with all applicable tax regulations and obtaining any necessary insurance coverage.

3. YOUR RESPONSIBILITIES

As an Elementor Affiliate, you agree to the following responsibilities:

  • Accurate Account Information: You are fully responsible for providing accurate and up-to-date information regarding your account. This includes, but is not limited to, your contact details, payment information, website URL(s) where Elementor is promoted, traffic sources, promotional practices, and any other information we may request. Failure to provide accurate or up-to-date information may result in exclusion from the Affiliate Program, temporary suspension, termination of your account, and forfeiture of any earned commissions.
  • Good Faith Referrals:You are required to act in good faith when referring clients. A client in good standing is defined as a new user who has provided accurate and valid contact information, holds an active account that complies with Elementor’s Terms of Service, and is not flagged for any fraudulent activity. An active account refers to a referred user who has created an account and maintained it for a minimum of 30 days.
  • No Alteration of Promotional Materials: You are not authorized to modify, copy, or alter any banners, icons, graphics, or any other promotional materials provided by Elementor. Any changes to these materials, including removing or altering copyright or trademark notices, require prior written approval from Elementor.
  • Prohibited Marketing Practices: You must not engage in blackhat SEO practices, spam link-building techniques, impersonating Elementor, cookie insertion, pay-per-click (PPC) brand advertising,automatic redirecting or similar deceptive techniques to generate referrals. These practices will lead to termination from the Affiliate Program.
  • No Use of Unauthorized Coupon Codes: You must not use coupon codes that are not authorized by Elementor.
  • Compliance with Laws: You agree to comply with all applicable laws, including advertising regulations. Any violation of legal standards may result in immediate termination from the program.
  • Loyalty and Reputation: You should act loyally towards Elementor, safeguarding its reputation, and refraining from any actions that could damage the brand. You should not advocate, promote, or encourage violence or discrimination against any person, organization, or governmental entity.
  • Adherence to Code of Conduct: You must comply with Elementor’s Third-Party Code of Conduct, which outlines ethical guidelines for your participation in the Affiliate Program.
  • Consequences for Violations: If Elementor detects patterns of violations of this Agreement, we reserve the right to suspend or terminate your affiliate account and cancel any pending commissions.
  • Termination for Misrepresentation: If it becomes apparent that Elementor would not have entered into an Affiliate Agreement with you had certain facts been known at the time of your application, Elementor reserves the right to immediately terminate the partnership and withhold payment for any previous earnings.

By participating in the Elementor Affiliate Program, you agree to comply with these responsibilities and understand that failure to do so may result in penalties, including suspension or termination of your affiliate account.

4. AFFILIATE ADVERTISING

Affiliates are permitted to use only approved promotional materials provided by Elementor to advertise Elementor’s services. These materials, including Elementor’s trademarks, logos, and slogans, are made available to you through your Affiliate Assets. By entering this Agreement, you are granted a non-exclusive, limited, non-transferable license to access, download, and display the approved promotional materials solely for the purpose of promoting Elementor’s websites and services.

In the event that the Affiliate Agreement is terminated for any reason, your right to access, download, and display Elementor’s approved promotional materials will be immediately revoked, without prior notice.

Inappropriate Advertising Practices

The following advertising practices are strictly prohibited:

  • Illegal or Spammy Methods: You should not engage in any blackhat SEO/spam link building techniques, impersonating Elementor, cookie insertion, or other similar techniques in order to generate more referrals for Elementor.
  • Pay Per Click (PPC) Campaigns: Bidding on Brand keywords, phrases, or variations of the “Elementor” trademark, or using the Elementor website as a display URL in paid ads, without our prior approval. See our PPC Guidelines
  • Copyright Infringement: Using non-unique, copyright-infringing content to promote Elementor.
  • Impersonation: Pretending to represent Elementor.
  • Traffic Generation Methods: Using pay-to-read, pay-to-click, banner exchanges, click exchanges, Brand PPV advertising or similar methods.
  • Incentives: Offering cashbacks, rewards, or other incentives to generate sales without our prior approval.
  • Coupon/Discount Codes: Offering price reductions, coupons, vouchers, or discount codes that do not appear on our official Site without prior approval.
  • Damaging Elementor’s Image: Using Elementor’s materials or trademark in a manner that may negatively affect our reputation.
  • Affiliate Tracking Misuse: Using iframes or other technologies that place your affiliate tracking cookie outside of an actual click-through.
  • Link Cloaking: Using link cloaking or masking to promote Elementor on unauthorized websites or networks.
  • Inappropriate Content: Your website must not contain lewd, obscene, illegal, or objectionable material, including but not limited to content related to hate, bigotry, pornography, adult themes, or any unlawful content.
  • Misleading Domain Names: Your domain name, company name, logo, trademark, or any associated materials must not include keywords, phrases, or variations confusingly similar to “Elementor” or third-party trademarks without prior approval.

Elementor reserves the right to determine the appropriateness of any promotional method you employ. Inappropriate advertising methods may result in warnings, suspension, or termination of your affiliate account, along with the cancellation of any outstanding commission payments. Additionally, any offensive or aggressive communication with your affiliate manager may result in an immediate and permanent ban from the Affiliate Program, with no exceptions.

5. AFFILIATE TRACKING COOKIES

Elementor tracks affiliate sales automatically using cookies. These cookies are placed in the browser of a user who clicks on your affiliate link to reach our website. Each cookie is stored for up to 45 days. If a user already has a cookie from a previous affiliate, it will be replaced with the new cookie generated by your affiliate link. Elementor is not responsible for any cookies that are intentionally deleted by the user.

6. INVOICING

Elementor will provide you with a commission statement in your Affiliate Area at the beginning of each new month. There is no need to submit a payout request, as long as a valid payment method has been provided and you have reached a minimum of $200 in commissions by the time of payment. In such cases, a payment will be made automatically.

If a payout request is required, it should be submitted via the specified email by the end of the month. For example, a request for commissions earned in October 2023 should be submitted by the end of November 2023. Payouts will be released by the 20th of the following month. Any request submitted after the end of the previous month will be processed in the next payment cycle.

The minimum payout amount for PayPal withdrawals is $200.

7. COMMISSIONS

Qualified Leads
Commissions will be paid only for a Qualified Lead, which is defined as a new customer who meets the following criteria:

  1. Click your affiliate link, subscribe to our platform within the specified timeframe, and make a purchase.
  2. Is not already known to us through another affiliate or prior independent registration.

The following conditions further define and limit Qualified Leads:

  • A lead is not qualified if:
    • They are an existing customer already registered in our system.
    • They are already associated with another affiliate.
    • They were acquired through prohibited activities, such as brand-bidding PPC campaigns.
    • They fail to click the affiliate link or are not properly associated with the affiliate’s tracking ID.
    • Their registration does not occur under the same tracking ID associated with the affiliate.

Commissions will only be granted for new purchases of specific plans listed in our affiliate system unless explicitly agreed otherwise in writing.

Prohibition of Self-Referrals
Self-referrals are strictly prohibited. You are not allowed to click on your affiliate links or banners and make purchases through them. If your IP address used to log into the Affiliate panel matches the one used for purchases, this will be considered self-referral. Similarly, the use of VPN services to bypass this rule will be considered a violation. Violations of this policy may result in the forfeiture of commissions and removal from the Affiliate Program immediately.

Calculation of Commissions
Commissions are calculated based on the company’s net revenue from Qualified Leads, excluding taxes, chargebacks, refunds, coupons, cancellations, collection costs, clearing costs, or other deductions.

You agree that our books and records are deemed as accurate and that our tracking is final.

Payment Terms

  1. You will only earn commissions once your total accrued amount reaches the minimum payout threshold of $200. If your commissions are below this amount, they will not be considered earned, and you will not be eligible for payment. 
  2. Payment Schedule:Commissions are paid in cycles and processed by the 20th of each month or sooner, following the completion of the 30-day refund policy period. For example, commissions generated in October will be paid by the 20th of December.
  3. Affiliates are responsible for all applicable taxes and fees related to commission payments.
  4. If a customer’s purchase is canceled or refunded within 30 days, the corresponding commission will not be credited.
  5. Refunds or chargebacks may result in deductions from future commission payments.

Review and Dispute of Commissions

  • We reserve the right to review all transactions to identify potential fraud, whether on the part of the customer or the affiliate. During such a review, payment of commissions may be withheld for up to 180 days while compliance with the terms of this agreement, applicable laws, and regulations is verified.
  • If you believe your commission has been calculated incorrectly or not attributed correctly, you must notify us by emailing affiliates@elementor.com within a reasonable timeframe.

Changes to Commission Structure
We retain the right to modify the commission structure or calculation method at any time. Alternative commission plans may be discussed with your assigned account manager upon review of the partnership.

Forfeiture of Unclaimed Commissions
If commissions remain unclaimed for over 12 months, they will be removed from your affiliate account’s balance.

8. TERMINATION AND SUSPENSION

You may cancel and terminate your affiliate account at any time by contacting us through the Affiliate Area. Elementor will send you a confirmation that your account has been terminated as requested.

We reserve the right to terminate your participation in the Program at any time and for any reason, effective immediately upon notification to the email address associated with your account, without providing any explanation. Upon termination, you must cease using all intellectual property associated with our company.

Account Suspension Due to Inactivity:
If your account shows no commission activity or referral traffic for a continuous period of twelve months, the following measures will be implemented:

  1. Your account will be suspended, and you will receive an email notification with a 30-day warning before any commission is deducted.
  2. Your account balance cannot go below $0. If your balance reaches $0, no further deductions will be made, and your account will be permanently closed.
  3. If no commission is generated within the 30-day notice period, your account will be permanently closed, and any pending balance will be forfeited.

After an affiliate account is terminated, any sales associated with the affiliate will no longer be tracked, and you will no longer qualify for future commissions. Additionally, an affiliate will be considered inactive if their account has not had any new conversions in the last twelve months. Inactive accounts will be marked as dormant, but can be reactivated upon contact.

If any commissions are due at the time of termination, they will be forfeited. If your account is terminated due to a violation of these Terms and Conditions, no outstanding commission payments will be made and no warning notice will be sent. 

Upon termination of your affiliate account, you are required to remove any promotional materials, links, logos, trademarks, and slogans associated with Elementor from your website within 3 business days. This provision survives the termination of the Affiliate Agreement. After termination, you will no longer have the right to use Elementor’s trademarks, logos, or slogans, and you must refrain from any actions that could harm the reputation, image, or business relations of Elementor with current or potential clients.

Affiliates must provide accurate and complete information, including their full address. Failure to do so may result in delays or termination of participation in the Program. Elementor reserves the right to deny approval or remove Affiliates from certain countries at its sole discretion, whether due to applicable laws or any other reason at its sole discretion.

Upon termination, this Affiliate Agreement will be automatically terminated.

Reactivation:
To reactivate a suspended account, you must generate commission activity within 30 days of the suspension notice. If activity resumes within this period, your account will be reactivated. Alternatively, reactivation may occur by contacting our support team at affiliates@elementor.com or by reaching out directly to your assigned affiliate manager. Failure to generate activity or contact us within this period will result in account closure.

9. CONFIDENTIAL INFORMATION

Our relationship is confidential; meaning that your commission is confidential, the fact that we paid you is not. You should add a decent disclosure if required by law that you receive a commission for every click on our banner, but you should not tell others what your specific commission is.

10. GOVERNING LAW

Any controversy, claim, or dispute arising under this Affiliate Agreement will be governed by and resolved in accordance with the laws and jurisdiction where the Elementor entity is located as stated in our terms of service.

11. CHANGES TO THE AFFILIATE PROGRAM TERMS
Elementor may update or modify this Agreement, including related policies, at any time  at its sole discretion. Any such changes or modifications will take effect immediately upon being posted to the Elementor website (this “Site”).

For significant updates, we will notify you by email or any other method we deem appropriate. By continuing to use the Site or participate in the Affiliate Program after the “Last Revised” date, you confirm your acceptance of the updated terms. If you do not agree to the changes, you must stop participating in the Program.

This Agreement outlines the terms of  your participation in the Affiliate Program and your relationship  with Elementor. By joining, you acknowledge and accept these terms.
